Agreement to Terms:
These terms and conditions govern all purchases from the online shop at www.OBAKU.com, which is owned by both OBAKU Limited (Hong Kong) and Obaku, LLC (USA). All transactions are subject to the laws of Hong Kong SAR for OBAKU Limited and the laws of the United States for Obaku, LLC. Placing an order implies acceptance of these terms, always accessible on the Obaku online shop. Please carefully read and understand these terms for a seamless shopping experience.
We encourage customers to thoroughly read and understand these terms to ensure an enjoyable and satisfying experience while using our online shop.
Description of products:
Obaku will take all reasonable care to ensure that all details, descriptions, images and prices of products appearing on the website are correct at the time when the relevant information was entered into the system. Although we aim to keep the website as up to date as possible, the information including Product Descriptions appearing on the website at a particular time may not always reflect the position exactly at the moment you place an order.
Purchasing Process:
- Locate the product you wish to purchase.
- Place the product in the shopping cart by clicking ["Add to Cart"].
- You have two options: continue shopping or ["Proceed to checkout"]. View your shopping cart at any time by clicking "Cart" in the upper right corner.
- Modify your cart by clicking "Remove" or edit quantities in the "Item(S)" box. For additional items, click "Continue shopping." Complete your purchase by clicking ["Proceed to checkout"].
- Enter billing details and select payment method (["Pay with my PayPal account"] or ["Pay with my credit card"]). Add a comment in ["Note to seller"]. You are responsible for ensuring correct customer information.
- Click ["Pay"] to complete the purchase.
- Review your order in the ["Your order summary"] box. Edit shipping and invoice addresses. Accept Terms and Conditions and click ["Pay"] to confirm your payment obligation.
- Receive an Order Confirmation via email. If a product is out of stock, you'll be notified of the expected delivery date.
- Once filled and shipped, receive an email with a FedEx, UPS, or USPS link, PayPal Transaction ID, and order number. For non-free shipping items, get a confirmation for your chosen shipping option.
- Order Online: Use major credit cards (Visa, MasterCard, Discover, American Express), ClearPay, ApplePay, or PayPal®. Add selections to your “cart” and proceed to Checkout.
- Phone Order (USA only): Call Customer Service at (704) 899-5250 from 8:30 a.m to 5:00 p.m Eastern time, Monday to Friday. Have your credit card details and item numbers ready.
- In-Store Order: Visit a nearby store using our Store Locator.
Order Processing Times (Applicable to USA):
- Orders placed after 11:00 am EST with free shipping will ship the next business day.
- Orders placed after 3:00 pm EST with express shipping will also ship the next business day.
Prices and Payment Terms for www.OBAKU.com Purchases:
- All prices are listed in your local currency, and the final amount will be charged in USD.
- The final amount includes free shipping when applicable, along with duties and taxes for worldwide delivery unless specified otherwise.
- The applicable price for your purchase is that listed on the website at the time of the order.
- Obaku accepts payments through PayPal, including VISA, MasterCard, American Express, Discover Card, Apple Pay and Klarna.
Delivery Information:
Obaku will ship goods via USPS (unless otherwise indicated) to a recipient within the United States. Delivery will be made to the provided delivery address. Expect to receive your order within 6-9 business days if the item is in stock. Obaku cannot guarantee specific delivery times due to local conditions. In case of stock unavailability during the order, we'll contact you by email to arrange and provide an estimated delivery date. If your package arrives damaged, please make a note when signing for the shipment. Once your order is shipped, you'll receive an email with the USPS tracking number, your PayPal Transaction ID, and order number.
Obaku ships worldwide via FedEx (unless otherwise indicated) to recipients outside the Hong Kong SAR. Expect to receive your order within 3-7 business days if the item is in stock. Local delivery conditions vary, and guaranteed delivery times can't be provided. If the product is out of stock, we'll contact you by email to arrange and estimate the delivery date. Shipments are insured against loss and damage during transit. Insurance lapses once the shipment is signed for. In case of a damaged package, note it when signing for the shipment. Once filled and shipped, you'll receive an email with a link to your shipment information on the FedEx website, along with your PayPal Transaction ID and order number. Confirmation for items not part of the free shipping offer will detail the chosen shipping option.
Right of Withdrawal:
If you choose to cancel a purchase, return the goods in the same condition and quantity as received. The packaging is integral to the product's value, so the return is incomplete without it. You are responsible for ensuring proper packaging. Please retain the packaging until you decide to keep the product. Any reduction in product value due to handling beyond what's necessary to assess its nature and properties is your liability. Proof of purchase, like a copy of the original Delivery Note, is required for a full refund. Refunds are made to the original payment card. Return the product(s) promptly, no later than 14 days from the withdrawal notice. Incomplete returns are those lacking packaging. Safely and securely package return goods to prevent damage during shipping, ensuring no sizing or wear has occurred. All returns must include original, non-damaged packaging and documents.
For December purchases, the right of return extends until January 15th.

from 09:00-18:00. Orders placed outside of these hours will be processed on the following business day.

Personal information in connecion with contests and promotions:
Obaku does not store the names and e-mail addresses of users who have participated in contests and promotions. If any information is collected, the contestants will be notified in a public release regarding the terms and conditions, rules, and guidelines of the contest.

Liability:
Obaku Denmark's responsibility for errors in relation to delivery is limited to existing conditions of sale. Obaku Denmark bears no direct or indirect responsibility for example, but not limited to, delivery delays, downtime, data loss, additional work, or other economic harm.
Force Majeure:
Obaku Denmark will be exempt from liability for damages and other penalties on the performance of the contract prevented, hindered, or delayed by circumstances beyond our control. As the release factor should be considered include government intervention, new/amended legislation, lack of state, war, fire, flood, labor disturbance, prohibitions, restrictions, sabotage, poor transport or weather conditions, or lack of delivery from suppliers and the company is exposed to criminal activity that affects activities.
Retention of Property:
All products remain in Obaku Denmark property until full payment is made.
Fraud:
All attempts of fraud are reported to the police and Obaku Denmark reserves the right to cancel the purchase if any suspicion is raised.
Termination:
Obaku Denmark reserves the right to conclude your account and/or your use of the www.obaku.com website at its sole discretion. For example, if Obaku Denmark suspects that you have violated these terms of use and conditions. This termination can be made without prior notice.
Changes to the terms and conditions:
Obaku Denmark may revise these terms of use and conditions from time to time. Every time you order a product from Obaku Denmark the general conditions in place at that time will apply to the contract between you and Obaku Denmark.
